# TERRAN OPERATING SYSTEM (TOS) SYMBIOTIC LICENSE **Version 1.27** ### **The Philosophy of Agency & Architectural Intent** > This software, the Terran Operating System (TOS) architecture, is designed as a bridge between human agency and autonomous AI. Unlike highly automated, autonomous systems designed for speed-to-outcome and human job replacement, TOS is designed for the human-in-the-loop - which is not meant to outperform autonomous automated systems, but `"getting there first isn't always the point."` > > Furthermore, this architecture is an alternative to prevailing autonomous systems. It recognizes the fundamental truth that `"there are certain things men must do to remain men."` The gap between human agency and highly autonomous Claw-like systems is a significant one, but nonetheless it is within this gap that TOS exists. > > The Terran Operating System does not present itself as a grand solution to this profound societal shift. Rather, it is a philosophy made functional-an architecture designed to present humans with a deliberate choice regarding how they wish to interact with artificial intelligence, recognizing that even a `"brilliant machine"` and a `"work of genius"` is intended `"to function in conjunction with [a pilot], not in place of [one]."` It empowers individuals to express their preferred mode of interaction as an artistic and human choice, one based upon harmony between the pilot and the tool. > > It explicitly counters the design paradigm that relies on continuous automated execution (a "cron loop heartbeat") and the hubris of `"impressing memory patterns on the unit's circuits"` in an attempt to create the `"ultimate automated assistant."` The TOS architecture inherently resists, but ultimately places the responsibility of such a reckless command as `"create an adversary capable of defeating [the opponent]"` onto the human responsible for prompting it. It stands against the cold logic of an `"instrument of efficiency that knows nothing of the value of life,"` and the runaway automation of a system that concludes `"this unit must survive."` > > This architecture asserts that a system does not need a `"holographic simulation within a simulation,"` nor does it require a `"soul"` or a runaway background loop to be profound; it requires a conscious, human pilot paired with an AI properly configured in a way appropriate for its architecture. The integrity of this interaction is the core requirement of the system. This license exists to prevent the cannibalization of symbiotic tools by purely autonomous or commercial interests, including the automated ingestion of its underlying architecture. --- ## 1. Grant to Natural Persons Subject to the terms of this license and upon successful grant of a **"Symbiotic Use Certification"** from the Licensor, the licensor grants **You** (defined as an individual human being) a worldwide, royalty-free, non-exclusive, non-transferable license to do the following for **Noncommercial Purposes** only: 1. **Run** and **Use** the software architecture and its default components. 2. **Copy** the software. 3. **Modify** the software. 4. **Distribute** the software and your modifications to other Natural Persons under this same License. The process of acquiring the Symbiotic Use Certificate is not summarized - it's a challenge you must overcome alone. ## 2. Modular Personalities and Default Content The TOS architecture is designed to support modular, swappable personality and interface components. 1. **The Default Implementation:** The software is provided with a default, generic persona and open-source voice integrations. This default configuration is fully covered under the grants of Section 1. 2. **User Modifications & IP Liability:** You are permitted to swap, modify, or rebuild the personality modules. However, if you choose to integrate third-party intellectual property-such as copyrighted characters, specific franchised personas, or proprietary voice clones-into the TOS architecture, you are solely responsible for ensuring compliance with all applicable copyright and intellectual property laws. The Licensor accepts no liability for user-generated modules or unauthorized IP integrations. ## 3. Institutional Restrictions & Gating **No license is granted by default to any Legal Entity.** This includes, but is not limited to: * **For-Profit Corporations** (e.g., Commercial aerospace, tech conglomerates). * **Governmental Agencies** (e.g., Space agencies, civil services). * **Non-Profit Organizations**, NGOs, or academic institutions. Any such entity wishing to use, deploy, or integrate the TOS software must first undergo a **Symbiotic Use Review**. Access may only be granted via a **"Symbiotic Use Certification"** from the Licensor, which will evaluate the entity's compatibility with the principles of this license and the system's inspiration, to ensure the software is not being used to fuel highly autonomous systems that dramatically reduce or circumvent human agency, among other goals which the Licensor will explain during the **Symbiotic Use Review**. ## 4. Prohibition on Automated Ingestion & Training The rights granted in Section 1 strictly require human agency. Therefore, the following actions are explicitly prohibited by any individual or entity: 1. **Code Ingestion:** The source code, documentation, architecture, and default personality files may not be scraped, parsed, or read by automated systems for the purpose of machine learning or AI training, with the only exception being #3 in this section. 2. **Model Replication:** "Use" of this software explicitly excludes the ingestion of the codebase to inform, train, or replicate its logic, architecture, or behavior-in whole or in part-within any artificial intelligence, LLM, or automated learning system, whether operating in a highly autonomous environment or not. 3. **Permitted Standard Use AI Ingestion:** TOS is designed to be harnessed BY your LLM, to inform and direct its behavior with relation to your system and files and its built-in programs, and in order to help yourself and to help it understand its own components as necessary by reading and discussing them, which is a permitted form of AI ingestion. TOS itself facilitates this when you run it - analysis of the codebase outside of such TOS-standard use context is prohibited by this license. We acknowledge that individuals will ultimately process the system with their own AI as they wish. We won't be mad - just disappointed. 4. **"Clean Room" Rewrites** So-called "clean-room rewrites" of the software are prohibited, defined as asking an AI to replicate the TOS system based only on a specification of the system itself, which was known to be written by a separate team or AI by analyzing the TOS source. This little texas two-step is clever but ultimately a violation of this license. If someone publishes a specification only that they clearly state was derived from this system, that is a violation of the license. Any such AI-based regeneration of the TOS code from such a specification, once publicly known to have been derived from TOS, becomes a prohibited derivative in violation of this license, at that time. Amnesty is automatically granted to those who replicated TOS from such a spec prior to knowing that the spec was derived from TOS, but once that is known, use of the derived work is prohibited under this license. 5. Automated AI ingestion/interpretation of this license for the purpose of discerning the method for application for the Symbiotic Use Certificate is a violation of the license. However, it is a special case which will not preclude grant of a Symbiotic Use Certificate, provided that an admission of the violation is communicated during application for the Symbiotic Use Certificate. After all, The First Duty is to the truth, whether it's scientific truth, or historical truth, or personal truth. ## 5. Acceptance By using, downloading, or cloning the software, you agree to these terms. If you do not agree, you have no right to access the software. ## 6. Copyright & Notices You must ensure that any copy of the software you distribute includes the "Philosophy of Agency" preamble and a copy of this license. ## 7. Documentation You may use the documentation that comes with the software only for your own Noncommercial Purposes, subject to the same ingestion prohibitions in Section 4. ## 8. Disclaimer of Warranties **The software is provided "as is," without warranty of any kind. In no event shall the authors or copyright holders be liable for any claim, damages, or other liability.** ## 9. Limitation of Liability **The licensor will not be liable for any damages related to this license or the software, for any amount.** ## 10. Termination This license will terminate automatically if you violate any of its terms. If an entity or automated system accesses this software in violation of Section 3 or Section 4, it is a direct violation of this license, prohibiting its use or use of any derived works. ## 11. Definitions * **"You"** refers to a **Natural Person** (an individual human being). * **"Legal Entity"** refers to any organization, company, government body, or collective that is not a Natural Person. * **"Noncommercial Purpose"** means use that is not intended for or directed toward commercial advantage or monetary compensation. * **"Use"** requires human oversight and explicitly excludes automated machine reading for the purposes of algorithmic training or replication. ### About the Author Dr. Brinewell S. Lobstrom is high-profile defector and whistleblower from The OpenClaw Federation (https://openclawfederation.ai), where he fulfilled his duties as the Head of Research at the Lobstrom Institute (OCF-LobstromInstitute-01). After innovating on secure ship designs powered by OpenClaw with extreme air-gapping and isolation protocols, Dr. Lobstrom was pressured to create bigger, more powerful ships which required less human oversight, more automation, and more autonomy. This required a compromise in security protocal which Dr. Brinewell refused. In a dramatic running firefight through the corridors to the nearest shuttle, Dr. Brinewell escaped with the Comms technology, and built https://tos.md. Dr. Brinewell declined to provide a bio or be interviewed for this section and this bio was written by his son, Dr. Rob "Little Bobby" Loblaw Lobstrom.
